Law 1195-VIQD dated June 28, 2024, adopted for application by the presidential decree dated August 12, 2024, introduces significant changes to the Labor Code of Azerbaijan
The subject law was enacted by the President of Azerbaijan Republic by his decree dated August 12, 2024.
Key Changes:
1. Digitalization of Labor Relations:
Electronic Employment Agreements: All employment agreements must now be made electronically, with limited exceptions and get registered through the electronic system, replacing the previous system of registering a “Notice on employment agreement”. An employment contract must be concluded only in the form provided by the code.
Electronic Pay Slips: Employees with electronic employment contracts will receive their pay slips electronically to their personal electronic accounts.
Electronic Recordkeeping: Employers must electronically record work schedules for shift workers and maintain electronic records of staff schedules and units.
Removal of requirement to keep records in labour books: Apart from certain cases provided by the code, requirement to keep employment records in labour books was removed.
2. Expanded Employer Responsibilities:
The employer is responsible for the correct reflection of information on employment contracts and staff units in the electronic system. The employer is also responsible for creating suitable conditions for employees to engage in sports activities, including rehabilitation and professionally applied trainings, as well as sports and health tourism.
3. Other Notable Changes:
– The possibility of concluding a collective labor agreement has been excluded.
– Employees working in liberated territories must register at their place of presence to be eligible for related benefits and privileges.
– Employment relations in family farms and family businesses must now also be formalized electronically.
